1. Introduction Welcome to The Petite Cartel website (the "Site"). These terms and conditions ("Terms") govern your use of the Site and your purchase of goods from us. By accessing this Site and/or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use this Site.

2. Definitions

  • "We," "Us," "Our," "The Company": Refers to The Petite Cartel.

  • "You," "Your," "Customer": Refers to the user of the Site and/or the purchaser of goods.

  • "Goods": Refers to the made-to-order clothing items available for purchase on the Site.

  • "Order": Refers to an order placed by you for Goods on the Site.

  • "Content": Refers to all intellectual property, including designs, text, images, and logos on the Site.

  • "User Content": Refers to any content (e.g., photos, reviews) you post or share in connection with our brand.

3. Our Contract with You

3.1. Basis of Sale: All Goods sold on this Site are made to order based on the specifications provided by you at the time of purchase. 3.2. Formation of Contract: Your placement of an Order constitutes a legal offer to us to buy the Goods. A legally binding contract between us is formed when we send you an Order confirmation email. 3.3. Pre-Booked Orders and Deposits: For pre-booked orders by waitlist customers, a 50% deposit is required. This deposit is fully refundable if you cancel at any point before the entire collection goes live to the general public. Once the collection is live, the deposit is allocated towards the final purchase price and becomes non-refundable. The remaining 50% will be due at that time. Failure to pay the balance will result in forfeiture of the deposit and cancellation of the pre-booked order.

4. Order Cancellations

You have the right to cancel your order at any time before it is dispatched. However, once our production process begins, we cannot accept cancellations as we will have already allocated resources and purchased materials specifically for your order.

To allow for cancellations, we have a 24-hour grace period from the moment your order is placed. If you wish to cancel, please email us immediately at hello@thepetitecartel.com within this 24-hour window, and we will issue a full refund to your original payment method.

After this 24-hour period, we will begin the production process for your garment. At this point, we are unable to accept cancellations. However, your right to return the item upon delivery for a "change of mind" remains in effect, subject to our Returns Policy.

5. Payment

5.1. Accepted Payment Methods: We accept payments via credit/debit card, processed securely through our integrated payment processor, Stripe. 5.2. Full Payment: For all standard orders placed by the general public, full payment is required at the time of placing the Order. 5.3. Currency and VAT: All prices are displayed in Pounds Sterling (£) and are inclusive of VAT at the current rate (if applicable). 5.4. Security: We do not store your credit or debit card details. All payment information is processed securely by our third-party payment provider, Stripe.

6. Price of Goods, Delivery, Returns & Refunds

6.1. Price and Delivery Costs: The price of the Goods will be as quoted on the Site at the time you submit your Order. Prices do not include delivery costs. Delivery charges will be shown to you during the checkout process. 6.2. Lead Time: All Goods are subject to an 8-week lead time for manufacturing and dispatch. This is an estimate, not a guarantee. 6.3. Returns and Refunds: This section is governed by our comprehensive Shipping, Returns & Exchanges Policy, which is a legally binding part of these Terms. 7. Intellectual Property

7.1. Our Content: All intellectual property rights in the Content on this Site are owned by us or our licensors. You may not copy, reproduce, or use any of this Content without our express written permission. 7.2. User Content: You grant us a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable license to use, reproduce, modify, and display any User Content you share with us (e.g., photos you tag us in on social media) for marketing and promotional purposes. This is at no cost to us and without any claim to ownership by you.

8. Data Protection and Privacy

We are committed to protecting your personal data. We will collect, use, and store your personal data in accordance with the UK General Data Protection Regulation (GDPR) and the Data Protection Act 2018. 9. Limitation of Liability and Force Majeure

9.1. Our Responsibility: Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law. 9.2. Indirect Loss: We will not be liable to you for any indirect or consequential loss or damage, or for any loss of profit, loss of business, or loss of revenue. 9.3. Force Majeure: We will not be liable for any failure or delay in performing our obligations where such failure or delay is caused by an event beyond our reasonable control (a "Force Majeure Event"), including but not limited to natural disasters, war, strikes, pandemics, or supplier failures. 9.4. Total Liability: Our total liability to you shall not exceed the total price paid by you for the Goods in your Order.

10. General Terms

10.1. Entire Agreement: These Terms constitute the entire agreement between you and us and supersede all prior discussions or agreements. 10.2. Severability: If any part of these Terms is found to be unenforceable, the rest of the Terms will continue to apply.

11. Governing Law and Jurisdiction

These Terms are governed by the law of England and Wales. You and we both agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
